1. Agreement to Terms

By accessing and purchasing from the NicheNib website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("User," "Customer," or "you") and NicheNib. If you do not agree with any part of these terms, you must not use or make purchases from our Site.

2. Products and Orders

NicheNib sells writing instruments, office organization products, paper & notebooks, and desktop tools. All product descriptions, images, and prices are subject to change without notice. We reserve the right to limit sales, discontinue products, or correct errors in pricing or product information. Your order constitutes an offer to purchase, which we accept by sending an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inaccuracies, or inventory limitations.

3. Intellectual Property Protection

All content on the NicheNib Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of NicheNib or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The compilation of all content on this Site is the exclusive property of NicheNib. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part, without our express prior written consent.

4. Limitation of Liability

To the fullest extent permitted by applicable law, NicheNib, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our total liability for any claim arising under these Terms or your use of the Site shall not exceed the amount you paid to NicheNib for the specific product giving rise to the claim in the twelve (12) months prior to the claim.

5. Refund & Return Policy

We strive for complete customer satisfaction. If you are not satisfied with your purchase, you may return most new, unopened, and unused items in their original packaging within 30 days of delivery for a full refund of the product price. Shipping costs are non-refundable. Returned items must be in resalable condition. To initiate a return, please contact our customer support at [email protected] with your order number and reason for return. Upon approval, you will receive instructions for the return process. Refunds will be processed to the original method of payment within 10 business days after we receive and inspect the returned item. Sale items or personalized products may be subject to different return conditions, which will be clearly stated at the point of purchase.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
